and Conditions

2. What we sell

On this site we sell exclusively digital products and services:

  • online training coursesdelivered live via video conference;
  • subscription services: GIS hosting, cloud storage, databases, WebGIS platforms;
  • consultancy and technical support in hourly packages.

We do not sell physical products. No shipping is required, there are no delivery costs and no product return procedures apply.

3. User account and data

An account is required to make purchases. You are responsible for the confidentiality of your credentials and the activities carried out with them. The data you provide must be accurate and up to date: we use it to provide the service, issue invoices, and contact you. The processing is described in the Privacy Policy.

4. Prices, VAT, and invoices

Prices are shown in euros and include VAT, unless otherwise stated in the product details. The price applied is the one displayed at the time of order confirmation.

We issue an invoice for every purchase. Businesses, professionals, and public entities requiring electronic invoices must provide us with their tax code, VAT number, and Unique SDI Code or PEC email — in addition to any references such as determinations, orders, or CIG for Public Administration. If these details are missing at the time of order, reply to the confirmation email with them.

5. Payments

We accept credit card and PayPal via an external payment processor, and bank transfer. For bank transfers, the order is confirmed upon receipt of payment: the details appear on-screen after ordering and are sent via email. Use the order number as the payment reference.

6. Online training courses

Activation of sessions. Each session is activated upon reaching a minimum of 2 participants. Once the minimum is met, we contact participants to agree on dates and times.

Start deadline. We commit to starting the session within 30 days of purchase. If the minimum number is not reached within this period, the participant may choose to: wait for the next available session, receive a voucher of equal value redeemable for any of our courses within 12 months, or a full refund of the amount paid. None of these options incur additional costs for the participant.

Delivery method. Courses are delivered live via video conferencing. Participants must provide their own suitable computer and a working internet connection. The educational software used (QGIS and open-source libraries) is free: we do not sell licenses.

Absences and catch-up. Sessions are recorded and remain available to participants for 30 days after the course ends. Absence from one or more sessions does not entitle participants to a refund, either partial or full, as recordings are available for catch-up.

Postponements and cancellations by us. If a session is postponed due to our fault, we propose an alternative agreed date. If the course cannot be completed, we refund the fee proportionally for the hours not delivered.

Certificate. Upon completion, we issue a personalized participation certificate, including the course name, duration, dates, format, and instructor. The certificate documents participation and does not constitute professional certification or accreditation.

Transfer of enrollment. Enrollment is name-bound. Before the course starts, it can be transferred to another person by notifying us in writing, with no additional costs.

7. Subscription services

Subscriptions are billed monthly or annually based on the chosen option and remain active until canceled. Cancellation must be communicated before the renewal of the current billing period and takes effect from the next period: the already paid period remains usable until expiry and is not refundable pro rata. Data uploaded by the client remains their property and can be exported before service termination.

8. Right of withdrawal (consumers)

If you purchase as a consumer, i.e. for purposes unrelated to your professional activity, you have the right to withdraw within 14 days from the contract conclusion, without having to provide a reason (Arts. 52 et seq. of the Consumer Code, Legislative Decree 206/2005). A written notification to info@smartlands-gis.com or via certified email is sufficient.

Note two cases provided by law:

  • if you expressly request that the service starts before the 14-day period expires and the service is fully performed within that period, the right of withdrawal is exhausted upon performance;
  • if the service has been partially performed, you will be charged proportionally for the services already rendered, and the remainder will be refunded.

The right of withdrawal does not apply to purchases made by businesses, professionals, and entities in the course of their professional activity, for which the conditions of Article 6 apply.

9. Refunds

Due refunds are processed within 14 days from the notification granting the right, using the same payment method used for the purchase, unless otherwise agreed. For bank transfer purchases, the refund is issued to the originating IBAN.

10. Training materials and intellectual property

Slides, handouts, exercise datasets, templates, and recordings are protected by copyright and remain the property of Smartlands SRL. They are granted to you for personaluse, including for internal professional purposes within your organization or practice.

The following is not permitted: sharing login credentials for sessions, allowing non-enrolled individuals to participate, independently recording lessons, redistributing, reselling, or publishing the materials. Non-compliance with these conditions results in course exclusion without refund.

Third-party software shown during lessons is excluded and subject to its respective licenses.

11. Technical requirements

Each course description specifies the minimum requirements. We are not responsible for malfunctions due to inadequate technical equipment, corporate or institutional network restrictions, or failure to install software within the indicated timeframe. We provide configuration assistance before the course starts.

12. Limitation of liability

We are liable for damages resulting from non-performance within legal limits. Any obligation to compensate for indirect or consequential damages, including data loss not attributable to us, lost profits, or business interruption, is excluded. Nothing in these Terms limits liability for fraud or gross negligence, nor the non-waivable rights granted to consumers.

Course content is for educational purposes and does not replace professional evaluations of specific cases.

13. Support and complaints

For support or complaints, write to info@smartlands-gis.com or to the certified email smartlands@pec.it. We respond within 5 business days. If the response is unsatisfactory, consumers may contact the relevant mediation and conciliation bodies under current legislation.

14. Changes to the Terms

We may update these Terms. Changes apply to orders placed after publication: for purchases already made, the Terms in effect at the time of order apply.

15. Applicable law and disputes

The contract is governed by Italian law. For disputes with a consumer consumer, the court of the consumer's residence or elected domicile has jurisdiction, if located in Italy. For disputes with businesses, professionals, and entities, the Court of Florence has exclusive jurisdiction.
